PTA at the School Level
DepED Order 54 s 2009

I General Policy

1. Every elementary and secondary school shall organize a PTA for the purpose of providing a forum for the discussion of issues and their solutions related to the total school program and to ensure the full cooperation of parents in the efficient implementation of such program.....

II Organization of PTA at the school level.

1. Membership in a PTA is limited to parent or in their absence the guardian of duly enrolled students and teachers in a given school.....

III General Assembly shall be composed of all parents of enrolled students of the school, Board of Directors and Officers of the PTA, School HEad, Homeroom Advisers, Subject Teachers and non teaching personnel.....

now i'm curious, is this right? i mean i just want to know what's needed because i read somewhere that a guardian can participate. and a guardian there is define as an individual authorized by the parent/s to whom the care and custody of the student has been entrusted. if this is the case, is it alright for me to be in the position or do i need a written authorization from the parents of my working student? and does a written authorization enough or do i need an attorney to process what documents.

You have the full authority to be a president to the PTA coz you stand a guardian to the student, the address she is using is yours and you are the one giving assistance to the student... you may not be the real parent but you are the guardian i myself is a president of PTA just continue the duties as a PTA president

I am a guardian of a graduating high school student. During our general membership meeting last July 12, 2013, I was nominated and elected as president. When I took over to preside the election of vice president, a protest was being raised by a PTA funded personnel assigned at the school canteen for the reason that only parents and guardians with legal adoption papers can be elected as president. I questioned the committee why was the protest not being raised while I was still being nominated? The principal apologized that she was not able to object when I was nominated because she was discussing other matter with a teacher and she ordered for the election of another president.

My question is, was the protest valid? Was the election of another president legal? As far as I have known, what they did was unlawful.

Furthermore, can a school canteen employee be funded by PTA fund and does she have the right to protest?

What legal action should I take regarding this matter?

A teacher was harassed, treaten, slundered/insulted by a grandparent of the child who's family stayed with. The incedent started when the teacher's purse with cash and important IDs was stolen as she realised on the late afternoon. The next day, one child told the teacher she saw the other child took the purse,by then the classrom PTA Officers called an emergency meeting held in the house of PTA CROs for the purpose to recover the lose/stolen property of the teacher if possible. With the mother's present and full consent who brought the child for questioning and hearing the child side of story. The child admit calmly that she done it and had gave the wallet to her Aunty and they trow away the IDs because its no use for them. The PTA Officer took video to prove as an evidence if there is any legal action to be done and keep it confidential. The grandad of the child was very furios especially knowing with the video and file complaint to DSWD and to the teacher District Office. They went to Barangy coucil for settlement of the issues but this grandad was outrageous shouting, swearing, finger pointing to the faces of PTA Officers and even treatening them who support the teacher as he can easy manupulate them because he is the head of this Barangy Police. The grandad went to the schoolto meet the school head and the teacher with regard the childs rights he told the teacher lots of insult and harrass word as the teacher never retaliated or say any words but the head to deal and beg him to just do it in a nice talk, he said "NO" he wanted the teacher to lose her license and sue her to court. The DSWD head Offcer called a meeting/hearing to the teacher with PTA Officers, the parent and child with the grandad. The DSWD Officer DON'T WANNA KNOW the teacher side of story all she wanted to say and own about is the child rights, the child's protections of the Law and from them, she also said to the teacher and PTA Officers even if the child kills they will save and protect the child. By her way of approached she encourage the grandad at the same time to intimedate and insult the teacher as he said "you are a teacher you don't know the LAW,,,, if the child will come home one day and crying because someone has bullied her I will then sue you to court!" Also the Police person who were present told the teacher and PTA Offcers what the done was wrong. The DSWD Officer demand PUBLIC Apology from the teacher as soon as possible.

Where is the right for the teacher who I would say the real victim of the Law itself??????

After few days, all the teachers from same school and family members of this teacher in trouble went to see the DSWD Officer, she sounds very harmonious and calm, very opposite from the previous meeting. All the teachers want was to clarify why she need to make a public apology as the Mr grandad was constantly harrashing this teacher. All the thinhs this DSWD Officer could say: It is required for this teacher to make public apology, and they must not gave to much consirations of that the grandad says because they are the professional and he is not..:(((

SO... IS IT AN EXCUSE TO INSULT, HARASS AND TREATHEN A TEACHER IF A PERSON IS NOT WELL EDUCATED... THATS A LOT OF BULLSHIT!!! IF YOU EXCUSE MY WORDS...

WHERE IS THE LAW FOR THE TEACHERS RIGHT WHO WERE VICTIM AND BULLIED BY FAMILY OF A CHILD WHO COMMIT CRIME AND WELL PROTECTED BY THE LAW IN THE PHILIPPINES.

Hi, Im a PTA Federation President of Pasay City, what I saw and experience after investigation, frm NCR to Local, DEPED have no power over the PTA. Do we need to have a police power to ran after the unscrpolous PTA volunteers who have unliquidated funds and now serving as PTA in other school. willy O. Rodriguez

Does the PTA need to be SEC accredited? I went to the DepEd site to further read the PTA by-laws, unfortunately the site can't be opened. Can you post the PTA by-laws here. thanks

what's the term of the PTA Officers? can they still run for another term with the same position? what, if one of the PTA officers is not a parent or guardian of our students what will happen to the organization? should they call for the meeting before their projects begin or a decision of the principal is enough to begin the project ? What if they don't informed all the teachers about their project?

Ako ay isang parents dito sa Kabacan pilot central School, last 2011-2012 school year ay siningil po ang mga anak ko school dues, sa pagkaka alam ko wla na pong babayaran ang mga anak namin, lalo na at APES level 3 accreditated pa ito, Pasensya kung ngayon ko lang na send ang Official Reciept na ginamit nila, ang tanong ko ngayon, 1. ito po ba ang official receipt ng DEp-ED, paki down load na lang po..2. magkano po ba ang subsidy ng DEP ED per pupil sa kagaya ng Kabacan pilot central school, ang population po nito ay more 2000 kung di po ako nagkakamali, ang alam ko ay 200 per pupil (speed low) at 250 per pupil (speed high), pa correct po ako kung mali po ang nasabi ko, 3. Bakit walang issue na School ID ang Kabacan pilot central school, actually school year 2012-2013 at 2013-2014 dina po ako nagbayad, kasi duda ako sa mga resibo na na issue nila..at di nila masagot ang mga tanong ko, during general assembly, ang alam ko rin po 2-4 times magkaroon ng General Assembly.. dami pa po akong tanong sana kaso, patapos na school year 2013-2014 minsan pa lang po kaming nag general assembly.pwede pa help naman...di ko kayang mag-isa para resolbahin ang mga tanong ko sa school ng mga anak ko, sabi ko maganda ang programa ng government, kaso ang implementing people ang problema na nakikita ko...ang alam ko sa OR ng Dep ED ay may TIN number, bakit ang i send ko na receipt ay wala...paki tignan din mabuti kasi ang siningil ay sakop din ng mga dep ed orders, bakit po nangyari ito, inuulit ko lang po..ecorrect nyo ako kung may mali sa mga na email ko sa inyo..salamat..

Good day sir, paki tulongan nyo naman po ako bakit patapos na po school year 2013-3014 wala pa ring PTA general Assembly meeting ditto sa school naming, Kabacan Pilot Central School, Kabacan, North Cotabato, Pakitanong na rin, kung kailangan ba na sa Barangay pa ayosin ang mga problema ng aming paaralan, Dami pa pong problema ang school naming, isa po yong Paano ginagastos ang MOOE (maintainance anf Other operating expenses) tapos naniningil sila na peke ang resibo, katunayan na send ko na po ito sa dep-ed national kaso 4 weeks na po wala pa rin response, kung naimbistigahan nap o.. ang Salamat po..

Can the principal or head teacher refuse to have a PTA or the equivalent of?

Are parent associations independent from the school? if not, can the parents come up with an independent organization that should tackle real issues that truly concern them and their children like k12, etc.? In most cases, PTAs are just implementing agencies of schools on their programs. A real Parent organization should not be under the institution. They have a wider concern as regards educating the children...

The DepEd Order says parents & "legal" guardians only. to be a legal guardian you have to get a court order stating that you are the legal guardian.
why is this so? this is to avoid persons with vested interest using the PTA as a political launch pad, so that they can be recognized come brgy election.
But you are not being dissuaded not to be a guardian of the child, you can be in as far as the school matters. the only thing is you can not run as PTA officer but you can be a PTA member. legal guardianship is as far as being officership only.

a. No need to SEC registered a PTA; the school principal shall issue recognition on the PTA and that would be enough. Deped order 54 states it all, the whats & hows of PTA organizations (from election, assembly, operations, do's and don'ts, etc.). no PTA will exist without the school recognition.
b. PTAs cant be that independent at all, 1st, it is the school who will issue recognition, 2nd, you have the same territory, the school & students. basically you are both mandated to be partners in the development of the education concerns.
c. non submission of PTA financial statement & violation of Deped orders are ground for the revocation of the school recognition.

On PTA terms of office:
1st, all general or central PTA officers are elected as " BOARD DIRECTOR" .. Deped says, not to exceed 2 consecutive terms; yearly PTA should conduct an election. if you won this year and the following year as Board Director, on the next year you can't run anymore
the 2 year term applies to being Board Director, so if you are elected this year as President, the following year as Auditor, you cant make that as excuse to run again for 3rd year by claiming "i was a president for 1 term" or an "Auditor", so i can run becoz we are given 2 years. that's wrong, 2 years mean for any position or whatever position. besides, you are first elected as Board so that means you have been elected twice as Board so you cant be elected as Board on the 3rd....
Some individuals seem top have a hangover for PTA officership ...they can't let go off the PTA matters (nasarapan ika nga) ...

that's precisely the purpose of Deped order 54, to keep away those scrupulous from using abusing and bastardizing PTAs ... even they are not allowed anymore, they keep on insisting to be one ...well some, school have the tendency to cahoot with them ... they still issue recognition even they know that they are not qualified anymore ...
you can charge these schools if ever they do that ...

MAm pakitulungan nman po aq isa po aqng homroom pta president sa isang public school mayroon po kc kaming pta contribution ngkakahalagang 400 buy daw aircon at pagawa ung stage ng school.. tutol po kc aq dun kc parang pinasan na nmin obligasyon ng school kc di nman ata tama na ishoulder nmin un willing nman aq tumulong kaso di nman tama na ganun kalaki tapuznasa private school kmi... my metting po kmi ngaung wek anu hu ba pwede q gawin....

Hello I am presently elected treasurer of our General PTA I would like to ask is it legal or allowed if we give financial assistance to a teacher who is requesting fund to be used in his training. I know the DepEd or each School have funds allotted or budget for the purpose of trainings and seminar. Do we have criminal liability later on if we pursue the release of fund coming from GPTA fund? Hoping for your positive reaction on this inquiry thank you.
